The decision of the Chair will become final unless successfully appealed to the Secretary or Deputy Secretary of Defense by the cognizant Department or Agency head or PDA within 10 working days. After a favorable disclosure decision is made, actual transfer of CMI cannot occur until the intended recipient government agrees to the conditions described in Subsection E.
